Toni Braxton settles child support case

On Behalf of | Jul 22, 2015 | Child Support

Child support arrangements can be one of the biggest challenges in a divorce proceeding. Arizona courts looks into various factors in order to determine a case for child support. One of the things that the family court judge looks into is the personal financial standing of the non-custodial parent, as well as the custodial parent.

In addition to the amount of money that is needed in order to sustain the children of the divorce, the courts also look into any special needs that the children might have. Defaulting on child support payments can often incur penalties from state agencies. In some extreme cases, arrears in child support payment can also incur federal charges for a non-custodial parent who has been repeatedly defaulted in the child support payment voluntarily and willfully.

Some of our readers may have heard that six-time Grammy winner Toni Braxton recently filed a lawsuit against her ex-husband for arrears in child support payment. According to her attorneys, she had not been paid child support payments under the court order for a long time. This had led to major financial duress for the singer, since she had also gone bankrupt following some health problems.

Braxton claims that she essentially depended on these child support payments in order to take care of her two children. However, instead of protracted litigation on this issue, her attorneys were reportedly able to get an out-of-court settlement on the arrears.

In many cases, the parties in a child support lawsuit prefer to get an out of court settlement by using alternate dispute resolution mechanisms, like mediation and arbitration. Such alternate dispute mechanisms often help achieve an amicable settlement. An amicable settlement is usually preferred for such cases, since the parties will probably want to keep an ongoing relationship for the benefit of their children.
